GOODBYE JOKERPASSAT, its probably TOTALLED!!!

Well 4 years of hard work on my car and many mods came to an abrupt end this morning. While on my morning commute to work with some slight rain coming down there were many accidents all over. I was slowing down to be safe for an accident when some a$$hole rear ended me. I pulled over to the side of the interstate but he just kept on going. I didn't see anything including him but witnesses from another accident saw him and some people got a plate. More then likely though he doesn't have insurance or a license or both so I'm screwed there. Further more I owe more on my car then what its worth so I'm screwed there too. Even beyond that I got a shitty dose of whiplash and more injuries to my broken face (still healing from back in October see the post).

My girlfriend is completely freaked out because I was on the phone with her when this happened and she heard me yell "oh god!" followed by the impact and people knocking on my window asking me if I needed an ambulance. She stood up at her work and cried because she didn't know what was going on.

So yeah so I'm waiting right now on the assessment for my vehicle. I have to rip out my enclosure and amp rack so everything can be assessed. I'm pretty worried because the impact was hard enough that it broke my entire center stack area where my radio is and a coolant line somewhere because I'm leaking coolant and oil. My zender spoiler is toast and my emblems. My entire bumper, trunk, and the quarter panel on the passenger side is caved in. Its all pushed forward so much that I can't open the doors on that side at all.

Well we'll see what happens and if anyone wants to host the photos I'll e-mail them to ya but I need to go start crying now over my potential loss... :cry: :cry: :cry:

That's awful, getting involved in a hit and run is my greatest fear. (happend to me a month ago, although just a scratch)

Hopefully this won't be the end, and if it is... strip the car completely if it's a write off. Then if you buy another B5 you can swap most of the parts onto the new one.

I feel for you buddy, best thing to do is spend time with your loved ones so you can forget about this tragedy.

Its a terrible, helpless feeling when you are rear ended. Car is toast and you did nothing wrong. This happened to me a little over a year ago when by GTI was totaled. Hopefully, they will get the guy and he will have insurance to cover your damages. Remember, cars can be replaced, humans can't. Take care of yourself and I hope everything turns out good.

That absolutely stinks!

Do you have uninsured / underinsured motorist coverage on your insurance policy? If so, you can claim against that for your injuries, etc. Just make sure you get a copy of the police report and any witnesses, etc.

As to your car, I don't know the value, but if you can find this guy's insurance company (or frankly, even yours), you can ride them pretty hard and they will usually give you a few more dollars for your car. Even if you put almost nothing down on it, assuming you've made regular payments, your loan balance shouldn't be too far from the value of the car.

If you don't have uninsured policy coverage, it may still be worth it to chase this guy down. He's got a car. He must have other assets. A good attorney can sue this jerk and could secure a lien against this guy's stuff.

Also, even if the car isn't his, you can get the real owner of the car. California (and I imagine most other states) have permissible use statutes that allow you to go after the owner even if he wasn't driving the car, and you can go after his insurance policy.

I would say to go immediately to your regular doctor (if you have health insurnace), and to have them check you out as soon as possible.

I'm going to my family doctor tomorrow and I plan on following up with the specialist that did my facial surgery to make sure everything is alright. My back and neck are fricken killing me right now. I was feeling alright but its just been getting worse and worse. I was thinking about contacting my lawyer but does anyone think its too soon to do that?

The accident happened near the Mitchell interchange on I-94 westbbound between Layton Av. and the interchange.

I do have uninsured/underinsured motorist coverage but I don't have lease/loan gap coverage and I think the value of my and my loan are about $4k off so I don't know what's going on with that. Fortunately my father is a detective in the neighboring city so he's kinda pushing his friendly courtesy with the sheriff's department up here to get this guy. I'll just have to wait and see all that happens tomorrow.

If its totalled I plan on posting a lot of items for sale including my custom kickpanels and my entire sub enclosure and custom amp rack but we'll see what happens tomorrow.

damn...that blows. i know how you feel, as i was in a similar situation where some jerk rear ended me and split. my car was totalled. make sure to take the car home and strip it, cuz they're not very friendly at the insurance lot. they don't like you taking stuff off the car, and they probably won't let you sit there for hours to get shocks/springs off. oh, and if your car is sitting at a collision shop, then they'll charge you a daily fee to keep your car there unless it's totalled or you get it fixed there.

oh, and from what you're saying, you don't have gap insurance, which really really blows since you could be out of a car plus be in 4k debt, although you should be able to get some from pain and suffering. go see a lawyer ASAP as he can advise you what to do so that you can get the maximum payout.

If I decide to sell the gear I think sell the amp rack, sub enclosure, sub, amp, and kickpanels. I'd just keep both sets of boston pro speakers since they sound great. The amp is built for the rack and the speaker is built for the enclosure so I'd like to keep those a matched set. The pics will be up shortly and you can see the system is intact and I'll be pulling it out tomorrow to be assessed just to verify if there is any damage to it.

Hmmm, not a bad idea! If there are organ donors, why not mod donors?
Anyway, sorry to hear about the accident. Regardless of how things turn out, here's hoping it's all for the best.

This is why I have hit and run insurance and noninsured motorist insurance...my Dad signed me up for every policy you could get. There are far too many bastards around here that could care less if they hit you. I always pray that if I am involved in a hit and run, I'm able to chase the jackass that did it.

AS for the bastard that hit you and ran well, we as a club will run this bastard and make sure he pays, i have a 32 inch 27 ounce Aluminum bat that says he will.

seriously tho i hope they find him and at least get a jugement on him at minimum.

You'd be best off running down the other guy's insurance (hopefully) because then you can really go after the true value of the car and the entire amount of your property loss and medical damage. The insurance follows the car also, so even if the dumb***k was driving somebody else's car, you'd be able to follow it.

The problem with using your own policy is the deductibles and the fact you're probably subject to "actual cash value" limits which GREATLY affects how much your claim will be settled for. Mods and such are right out the window. It would not be pretty. I believe uninsured on your own policy works the same way.
