I layed down some hard-earned cash...$$$lots$$$...on a '03 Passat pretty near 7 days ago and the dealer appears to be having a hard time locating the '03 that we agreed upon. Not so extravagant...1.8T, Leather, Monsoon, Reflex Silver on Grey leather. The sales manager tried to talk me into a different color interior and/or exterior...NOT!! So I'm stressing here! I've talked to a few other dealers a bit further than I'd like to travel but they assured me that they would have my car within 2 days. I gave my current dealer a deadline of 3 days and we'll see how this plays out. How obligated am I, if at all, to the current dealer? I admit I was foolish in giving them such a large deposit...12k

Yikes! With that kind of cash down, they should be rolling over for you. You may be able to ask another dealer if there is one like that inthe pipeline somewhere. I know of a couple of dealers around "here" (hint: look up) who are glad to help out.

Sometimes a car has to be ordered. Grey/grey is not that easy to find.

What did you sign?

If you didnt sign the final line you can always tell him to give you your cheese back. If nothing else that would AT LEAST ruffle enough feathers to make them look a little harder.

EDIT: On second thought, I would just go right down there right now and take my money back--no questions asked. Then go home, regroup, and find another dealer to buy from. Giving idiots money is a bad idea.

they are obligated to get you what you want or give you your money back....i'd take my money and run if they aren't willling to help you...my dealer got me the car i wanted in the height of people having to order b5.5s and ontop of that my car was a super rare color

I'm surprised to here that grey on grey is not that easy to find! Although darker colors may be somewhat more appealing I'm from the old school...lighter colors tend to show less dirt...I guess I'm just showing my age but I'm still a "gear head" from way back...the sixties!

k-man,

I passed up a Silverstone/Grey leather (w/same options) at New Milford VW (CT) back in December (see signature).

If the dealer can find you the car you want then he will get it for you. Another dealer 2 or 4 hours away isn't going to have any more luck getting it than your original dealer. If you want your money back you can get it without too much problem. I've done it.

If your dealer says he can't get it then the other dealers that say they can get it in two days are just blowing smoke up your wazzoo.

Trust me, the dealer you're now dealing with wants to sell you a car... no matter what.

Of course this is all based on my experiences buying cars. YMMV.

That's assuming that your original dealer is willing to put in the footwork to find your car (aka: earn your money) and not sell you what's on the lot. It sounds like your dealer wants to sell a car, it's just not the one you want. Other dealer's may work harder for your money. ymmv

This somewhat shocks me. I've been to 4 different dealerships and trying to find anything OTHER than Reflex Silver has been hard. I've noticed lately though that since the cars don't appear to be moving, the color choices are more varied. We were all set on Colorado Red, but only saw one variant in that color in the months we looked, so decided on Candy White or Silverstone grey. Finding a grey interior was tough too, everything we saw in the trim we were interested in was black.

True... but some dealer are also more shady and have more questionable practices than others. The devil you know is sometimes better than the devil you don't know.

I'd say call the current dealer, demand to know when he will have your requested car for you. If the time frame isn't acceptable, tell the dealer your coming down to get your money back. If the time frame is acceptable – great, sit tight and wait for your car to come in. Tell him that if it doesn't come in when he said it will you will come down to his dealership and get your money back.

Before we bought our Passat we had a deal on a 2000 Tornado Red Jetta TDI with black leather and the luxury package. Our dealer didn't have one but said he would locate one for us. None were available after three weeks of trying so we got our money and went to another dealer. The same thing happened there.

on you original post. If you have not tatken delivery of the vehicle you are not obligated at all. At least in California.

Before purchasing my car back in 1999, I had signed for and put 1k down towards a Mazda 626 loaded that was due to arrive at the dealer in five days. I went home thought about it , thought about it some more and called the next day an cancelled, I also put a stop payment on the check. The dealer tried going after me but I never took delivery of even the keys and they couldn't do anything.

Good luck getting the car you want. Also Bonthron is right his advice is very good.

Here's a quote from my dealer yesterday ..."We are still waiting for the other dealership to return our call. I will definitely have an answer for you tonight"

And guess what...Not even a damn courtesy call! I would have rather they called to tell me the find fell through instead of blowing me off completely!

I hate the thought of starting over with another dealer that may or may not be able to get me the car but I'm inclined to think that this represents the kind of service I can expect from my current dealer after the sale, so maybe I'll just move on.

When we shopped for our variant, we wanted reflex silver, too. Frankly, the only interior color I could find was black (which was fine by me, since I wnted black leather). I think the grey interior is the stumbling block for him.

its my understanding that as long as you don't drive the car off the lot (even if you DID sign a sales contract) the sale isn't consumated. so you can definitely get your money back.

and don't EVER give that kind of deposit again. maybe $100 - but NOT the sum you gave! there's simply no need or benefit to doing that!!

I have since called my current dealer and insisted on a refund. I am heading to another dealer this afternoon as he has an '03 GLS with everything I want except for the Monsoon

and not having monsoon is a blessing. you can get an aftermarket install for probably less AND know that the sound will be so much better!

While almost everything about my local dealer is poor, they DID get my white V6 glx with greay leather in one day, from a hundred miles away in North Jersey.
I think I put $100.00 down...

Maybe they were afraid I would get a bmw or altima?

The good news...drove about 80 miles to a MA vw dealer and there was my car, everything I wanted except the monsoon.

The bad news...first dealer will not refund my deposit until 10 days have passed...their policy. But they were sure quick to cash my check!

Oh well, a lesson well learned

and they collect interest on it, all the while. you should ask them for the interest on it too since its YOURS and not theirs.

if it was me, I'd yell and scream and make a commotion in the middle of the store until they wrote me a check for the deposit. or try to work it with the other dealer that they get the money from the first dealer (your check amount) so you can buy the car today.

if the 2nd dealer wants your biz, they'll do this. it should be pretty easy - IF you are a hard-ass - and sometimes you have to be when dealing with stealerships.

btw, here's a story about how I used one dealer 'against' another (sort of).

this was when I was buying my used bmw 540. I found a dealer who SAID they had the car I wanted (color, options, etc). I called and they said they had it. I went there and they couldn't find it on their lot but they assured me it was there (ha ha). we spent at least 3 hrs talking numbers. finally I got the numbers I wanted. and it was closing time, and I had a friend drive me to that dealer (I just sold HIM MY CAR so I was car-less. careless? hmmm. anyway...)

so they gave me a loaner (3er) until 'my' car came back (they said it was on loan to the owner's son. ha ha. yeah right.)

so the next day I get a call from them - good news and bad news. well, bad news only. the car was rear ended. what do I want to do - wait for the repair or choose another one?

see, they had me, sort of. they loaned me a car and it was a long drive (an hour or two) to get there. they did that on purpose, I bet. to make it easier to force me to buy SOMETHING from them. I bet they took my lowball number knowing they'd never sell me a car at that price - just to lock me into their stealership.

so what did I do? I took that loaner and went to a local bmw store. found a car there I liked and asked them if I could drop it off and have THEM return it to the long distance place. and they did (since the sale depended on it). they signed for the loaner and back to concord bmw (oops!) it went.

so the laugh was on them. not only did I not buy a car from them, but I had a free loaner for a few days and didn't have to drive back or deal with those sleazes. right on! ;-)

the morale of the story: EVERYTHING is negotiable. and never let yourself be locked in. ever. always have an 'out'.
